Topic: Elder Financial Abuse: Recognizing Signs and Understanding Reporting Responsibilities

The number of elder financial abuse cases continues to grow each year and is becoming a significant litigation practice area. More than one million complaints are filed each year in the United States, yet only one in ten is actually reported. Elder financial abuse is a daily reality in nursing homes and residential care facilities, and over 85 percent of these cases involve a family member. Welfare and Institutes Code Section 15610.30 defines elder financial abuse, and Senate Bill 1018 was enacted Jan. 1, 2007 to mandate reporting of suspected financial elder abuse by bank employees and others, which can be based on “mere reasonable suspicion.”

This program will describe various types of elder financial abuse, along with indicators to be on the lookout for and suggestions on how Estate and Financial Planning Committee members can assist in the prevention of this often heartbreaking situation.

Speakers: Stu Robken, CPA/ABV, CVA, and Lou Robken, CPA/ABV, CFE

Stu Robken and Lou Robken are the principals of Robken & Company, a forensic accounting firm in Carmichael specializing in litigation services and consulting. Their practice areas include marital dissolutions, business valuations, tracings, economic damages, fraud investigations, bankruptcy accountings and other special accountings.

They have each testified as an expert witness in elder financial abuse matters, as well as in numerous other litigation cases in many Northern California superior courts. Stu has been appointed as the court’s expert in several of these jurisdictions and in Los Angeles County.

Both are active in professional organizations, including CalCPA, where Stu recently served on the state board of directors. They were each Sacramento Chapter presidents and were elected as California delegates to the AICPA. Stu is a member of the Sacramento County Treasury Oversight Committee and just completed a term as committee chair.
